ইসলামী শরীআহর আলোকে ড্রাইভিং : একটি পর্যালোচনা | Driving in the Light of Islamic Sharī،ah : an Analysis

Abstract

Vehicle is an imperative part of modern civilization. Driving is an inseparable part of it. A driver plays key role in this regard. A separate department together with relevant laws, called as traffic laws, has been established to control vehicle drivers. Traffic laws of different countries of the world have provisions which clearly describe driver’s required qualifications, skill, professionalism and duties. This is because, driving is a job which is directly connected to human life. One of the main objectives of Islamic Sharī،ah is to protect human lives. For this, Islam has declared necessary rules and regulations to ensure protection and safety of human lives. Islam has set necessary guidelines, principles and laws for driving vehicles in roads, water-vehicles in seas and air-vehicles on airways. It is a crucial demand of time to modify existing traffic laws in the light of relevant provisions in Islam. Against this backdrop, this article presents and discusses views of Islamic Sharī،ah on vehicle driving, driver’s qualifications, duties and responsibilities as well as safe roads, traffic laws, characteristics of vehicles and compensation for road accidents etcetera. The article has been prepared following descriptive and deductive methods. Descriptive method has been applied in discussing relevant Sharī،ah rules, while deductive method for presenting means of application of related Sharī،ah rules in this regard. The article facilitates understanding of Sharī،ah rules related to vehicle driving and necessary outlines for avoiding road accidents.

সারসংক্ষেপ: যানবাহন আধুনিক সভ্যতার একটি অপরিহার্য অংশ। এর অবিচ্ছেদ্য অঙ্গ যানবাহন পরিচালনা। ড্রাইভার বা চালক এ ক্ষেত্রে মুখ্য ভূমিকা পালন করেন। তাই যানবাহন চালকদের নিয়ন্ত্রণের উদ্দেশ্যে গড়ে ওঠেছে স্বতন্ত্র বিভাগ ও নিজস্ব আইন, যাকে আমরা ট্রাফিক আইন হিসেবে জানি। বর্তমান বিশ্বের বিভিন্ন দেশের ট্রাফিক আইনে যানবাহন চালক বা ড্রাইভারের যোগ্যতা, দক্ষতা, পেশাদারিত্ব ও তার কর্তব্য বিষয়ে সুস্পষ্ট বিধান রয়েছে। কেননা বিষয়টি সরাসরি মানুষের জীবনের সাথে সম্পৃক্ত। ইসলামী শরীআহর অন্যতম উদ্দেশ্য হল ‘হিফযুন নাফ্স্’ (حِفْظُ النَّفْسِ) বা জীবন সংরক্ষণ। এ কারণে ইসলাম জীবন সংরক্ষণ ও জীবনের নিরাপত্তা নিশ্চিত করার জন্য প্রয়োজনীয় বিধি-বিধান প্রণয়ন করেছে। সড়ক, নৌ ও আকাশ পথে চালিত বিভিন্ন যানবাহন এবং অন্যান্য যান্ত্রিক পরিবহন পরিচালনার ক্ষেত্রেও ইসলাম প্রয়োজনীয় নীতিমালা ও বিধান নির্ধারণ করেছে। ইসলাম প্রদত্ত এ সব বিধানের আলোকে সমসাময়িক ড্রাইভিং সংক্রান্ত বিধি-বিধান নিরূপণ করা সময়ের অনিবার্য দাবি। এ প্রেক্ষাপটকে সামনে রেখে বক্ষ্যমাণ প্রবন্ধে ইসলামী শরীয়ার আলোকে যানবাহন ড্রাইভিং, ড্রাইভার বা যান-চালকের যোগ্যতা, দায়িত্ব-কর্তব্য, নিরাপদ সড়ক, ট্রাফিক আইন, যানবাহন তথা গাড়ির বৈশিষ্ট্য এবং দুর্ঘটনার দায় ইত্যাদি বিষয়ে আলোচনা করা হয়েছে। প্রবন্ধটি রচনার ক্ষেত্রে বর্ণনামূলক (Descriptive Method) ও অবরোহ পদ্ধতি (Deductive Method) অনুসরণ করা হয়েছে। সংশ্লিষ্ট বিষয়ের শরয়ী বিধান আলোচনার ক্ষেত্রে বর্ণনামূলক পদ্ধতি এবং শরীআহ নির্ধারিত বিধানের বাস্তব অনুশীলনের পদ্ধতি উপস্থাপনের ক্ষেত্রে অবরোহ পদ্ধতি প্রয়োগ করা হয়েছে। প্রবন্ধটির মাধ্যমে যানবাহন চালনা সংক্রান্ত শরয়ী বিধান অবগত হওয়ার পাশাপাশি দুর্ঘটনা এড়ানোর জন্য করণীয় বিষয়ে নির্দেশনা পাওয়া যাবে।
