মিথ্যার স্বরূপ ও বিধান : প্রচলিত ও ইসলামী আইনের আলোকে একটি পর্যালোচনা|Nature and Punishment of Lying: An Analysis in the Light of Islamic and Conventional Law

Abstract

Lying is the root of all sins. The evil of lying is comparatively greater than that of all the offences committed in the world. People lie about the smallest things in their daily life. It is a great sin to lie about keeping a promise made to someone, testifying about something, keeping a matter secret. The spread of falsehood in family, social and state life today needs to be eradicated as soon as possible. There is no alternative to religious teachings in this regard and family, society and state life can be saved from being demolished through the proper observance of religious dictates. This article sheds light on the consequences of lying, its punishment, role of law and Islamic injunctions to prevent lying in different spheres of the society. Moreover, the author did not forget to portray the picture of contemporary society engulfed in lying. Most importantly, the author demonstrates that adherence to the commandments of Allah (SWT) as enunciated in the Qur’an and traditions of the Prophet (PBUH) can play a pivotal role in eradicating lying in different spheres of the society and state. This write-up has employed descriptive, analytical and comparative research methodologies.

সারসংক্ষেপ : মিথ্যাই সকল পাপের মূল। পৃথিবীতে সংঘটিত যতো অপরাধ আছে তার অকল্যাণের চেয়ে মিথ্যার অকল্যাণটা তুলনামূলক অধিক। মানুষ তার দৈনন্দিন জীবনে খুব ছোটো ছোটো বিষয়েও মিথ্যা বলে থাকে। সাধারণত কারো সাথে কৃত অঙ্গীকার রক্ষা করা, কোনো ব্যাপারে সাক্ষ্য দেয়া, কোনো গোপন বিষয়ের আমানত রক্ষার বিষয়ে মিথ্যা সংঘটিত হলে তা মারাত্মক গুনাহ। বর্তমানে পারিবারিক, সামাজিক ও রাষ্ট্রীয় জীবনে যেভাবে মিথ্যার প্রসার ঘটছে তা অতি শীঘ্রই নির্মূল হওয়া প্রয়োজন। আর এ জন্য ধর্মীয় অনুশাসনের কোনো বিকল্প নেই। এতে করে পরিবার, সমাজ, রাষ্ট্রীয় জীবন ধ্বংস হওয়া থেকে রেহাই পাবে। আলোচ্য প্রবন্ধে ইসলামী শরীয়াহ এবং প্রচলিত আইনের বিভিন্ন ধারার ভিত্তিতে আমাদের বর্তমান সমাজের বেশ কিছু চিত্রের সাথে মিলিয়ে মানবজীবনের বিভিন্ন ক্ষেত্রে মিথ্যা বলার পরিণাম, শাস্তি ও বিধান, মিথ্যাচার প্রতিরোধ ও প্রতিকারে ধর্মীয় অনুশাসন পরিপালন এবং সমাজ ও রাষ্ট্রে মিথ্যা পরিহার করার জন্য ধর্মীয় অনুসরণ অন্যতম কার্যকর উপায় সম্পর্কে আলোচনা উপস্থাপন করা হয়েছে। প্রবন্ধটি রচনার ক্ষেত্রে বর্ণনা, বিশ্লেষণ ও তুলনামূলক গবেষণা পদ্ধতি অনুসরণ করা হয়েছে।
