ইসলামী ব্যাংকব্যবস্থায় ইছতিসনা বিনিয়োগ: মূলনীতি ও প্রায়োগিক বিশ্লেষণ | Istisnā Investment in Islamic Banking: Analyses of Principles and Application

Abstract

In contemporary Islamic Banking Industry istisnā as an investment product has gained familiarity. Istisnā (عقد الاستصناع) can be defined as a contract to construct something within a stipulated timeframe and in a certain manner. Istisnā contract is appropriate for provioing liquidity for construction projects which has been proposed or is in the process of being built.  In many countries nowadays large construction projects including power plants, airports, seaports, highways etc. are financed using istisnā contract. This paper aims to discuss and analyze the definition of istisnā its legal analyses, application and  investment sectors of istisnā in Islamic Banking system. Employing descriptive and analytical methods, the paper facilitating the understanding of various key issues related to istisnā and its practical application by Islamic banks and financial  institutions as well as procedures of issuing and investing istisnā sukūk.

সারসংক্ষেপ: সমসাময়িক ইসলামী ব্যাংকব্যবস্থায় বিনিয়োগ সেবা হিসেবে ‘ইছতিসনা বিনিয়োগ’ অতি পরিচিত একটি নাম। নির্দিষ্ট সময়সীমার মধ্যে নির্দিষ্ট পদ্ধতিতে কোন কিছু নির্মাণকল্পে অনুরোধ কিংবা চুক্তি করার নাম হচ্ছে ইছতিসনা (عقد الاستصناع)। পরিকল্পনাধীন কিংবা নির্মাণাধীন কোন প্রকল্পে প্রয়োজনীয় তারল্য সরবরাহ করার জন্য ইছতিসনা চুক্তি একটি উপযুক্ত মাধ্যম। অনেক দেশেই বর্তমানে পাওয়ার প্লান্ট, বিমান বন্দর, সমুদ্র বন্দর ও মহাসড়কসহ বড় বড় প্রকল্পে ইছতিসনা চুক্তির মাধ্যমে বিনিয়োগ করা হচ্ছে। বক্ষ্যমাণ প্রবন্ধে ইছতিসনা চুক্তির পরিচয়, আইনী পর্যালোচনা, বাস্তবিক প্রয়োগ, ইসলামী ব্যাংকিং এ ইছতিসনার আলোকে বিনিয়োগের খাত ইত্যাদি বিষয় আলোচনা ও বিশ্লেষণ করা হয়েছে। বর্ণনা ও বিশ্লেষণমূলক পদ্ধতিতে রচিত এ প্রবন্ধ থেকে ইছতিসনার বিভিন্ন অনুষঙ্গ অবগত হওয়ার পাশাপাশি বর্তমান প্রেক্ষাপটে বিশেষত ইসলামী ব্যাংকিং ও অর্থলগ্নি প্রতিষ্ঠানে এর বাস্তব প্রয়োগ পদ্ধতি এবং ইছতিসনা সুকূকের ইস্যু ও বিনিয়োগ প্রক্রিয়া জানা যাবে।
