ইসলামী ব্যাংকসমূহে চর্চিত ‘মুরাবাহাতু লিল আমিরি বিশশিরা’: একটি শরয়ী বিশ্লেষণ | An Investment Method of ‘Murābahatu Lil Āmiri Bish-shirā’ practiced by Islamic Banks: a Sharī،ah based analysis

Abstract

Murābahatu Lil Āmiri Bish-shirā (مُرَابَحَةُ لِلآمرِ باِلشِّرَاءِ) Murābaha in purchase order) is one of the investment methods exercised by Islamic Banks and financial organizations in the modern days. In recent days this method of investment, established based on traditional Murābaha, is most commonly exercised in many countries including Bangladesh. Present article is aimed to discuss process of transection through this investment method, opinion of Islamic scholars on legality of this kind of investment in the light of Islam, to remove doubt and confusion about this method and to present a guideline for exercising the method by Islamic banks as per the instruction of Sharī،ah. The article is prepared mostly following descriptive method together with applied method of presentation. The article tries to prove that investment through this kind of method, i.e. ‘Murābahatu Lil Āmiri Bish-shirā’ and dividend through this investment can be approved by Sharī،ah and be Halāl if it is exercised as per the instruction of Sharī،ah.

সারসংক্ষেপ: ‘মুরাবাহাতু লিল আমিরি বিশশিরা’ (Murabaha in purchase order) আধুনিক যুগে ইসলামী আর্থিক প্রতিষ্ঠান ও ব্যাংকসমূহে অনুসৃত অন্যতম বিনিয়োগ পদ্ধতি। সনাতন মুরাবাহার ভিত্তিতে উদ্ভাবিত এ বিনিয়োগ পদ্ধতি বাংলাদেশসহ বিভিন্ন দেশে সর্বাধিক অনুশীলিত। এ লেনদেনের প্রক্রিয়া, এর বৈধতা সম্পর্কে আলিমগণের মতামত, এ সম্পর্কিত সন্দেহ সংশয় নিরসন এবং ইসলামী ব্যাংকসমূহে এর শরীআহসম্মত অনুশীলনের দিক নির্দেশনা উপস্থাপন করাই এ প্রবন্ধের উদ্দেশ্য। প্রবন্ধটি রচনার ক্ষেত্রে প্রধানত বর্ণনামূলক পদ্ধতি গ্রহণ করার পাশাপাশি ক্ষেত্র বিশেষে প্রায়োগিক পদ্ধতির আশ্রয় নেয়া হয়েছে। প্রবন্ধ থেকে প্রমাণিত হয়, মুরাবাহাতু লিল আমিরি বিশশিরা যথাযথ শরীআহ পরিপালন করে অনুশীলন করা হলে তা হালাল ও এর থেকে প্রাপ্ত লভ্যাংশও হালাল। তবে ইসলামী আর্থিক প্রতিষ্ঠান ও ব্যাংকসমূহকে খুব সতর্কতার সাথে এ পদ্ধতির অনুশীলন করা অপরিহার্য।
