Abstract

The economic importance of an article is a testimony to the creativity of the mind of the writer. In this regard, the issue of copyright has attained importance in the context of the discovery of the printing press and the rise of the economic activities of publishing houses. As a result, there has arisen a necessity to understand the copyright concept in the light of Islam. Keeping this necessity in mind, the article presents the opinions of early and modern scholars the issue of copyright and a discussion on Shariah rulings pertaining to it. The article uses descriptive methods to prove that copyright is a type of wealth similar to other types of wealth. Every owner of wealth has the right to protect and sell his wealth. Thus the owner to a copyright has the right to protection and sale of goods as entitled to in lieu of his copyright.

সারসংক্ষেপ: লেখকের মস্তিষ্ক নি:সৃত উৎপাদন হিসেবে লিখনীর অর্থনৈতিক গুরুত্ব স্বীকৃত। বিশেষত মুদ্রণযন্ত্র আবিষ্কার ও প্রকাশনা প্রতিষ্ঠানের বাণিজ্যিক তৎপরতার প্রেক্ষিতে গ্রন্থস্বত্ব একটি গুরুত্বপূর্ণ অনুষঙ্গে পরিণত হয়েছে। ফলে ইসলামী দৃষ্টিকোণ থেকে গ্রন্থস্বত্বের বিধান নির্ণয় সময়ের অনিবার্য প্রয়োজনে পরিণত হয়েছে। এ প্রয়োজনীয়তাকে সামনে রেখে গ্রন্থস্বত্বের বিধান সম্পর্কে পূর্বসূরী ও আধুনিক আলিমগণের মতামত উপস্থাপন ও এর শরয়ী বিধান বর্ণনার উদ্দেশ্যে বক্ষ্যমাণ প্রবন্ধটি রচিত হয়েছে। বর্ণনামূলক পদ্ধতি অবলম্বনে রচিত এ প্রবন্ধ থেকে প্রমাণিত হয়েছে যে, গ্রন্থস্বত্ব অন্যান্য সম্পদের মতো একটি সম্পদ। প্রত্যেক মালিক নিজের সম্পদ সংরক্ষণ ও বিক্রির অধিকার রাখেন। তাই গ্রন্থস্বত্ব সংরক্ষণ করা ও এর বেচাকেনার পূর্ণ অধিকার গ্রন্থ প্রণেতার রয়েছে।
