ধর্মীয় উত্তরাধিকার আইনে নারীর অংশ : একটি তুলনামূলক পর্যালোচনা | Inheritance of Women in Religious Succession Law: A Comparative Study

Abstract

Women's right is one of the most talked-about issues of today. Inheritance is the most important component of women's rights. Different civilizations and religions consider women from different viewpoints and perspectives. Some civilizations denied their rights completely, while some others recognized their dignity and rights. Against this backdrop, this article has been prepared to conduct a comparative study to analyze the status between different religious laws pertaining to provisions for inheritance of women. As scope of the study the religions of Hinduism, Buddhism, Judaism, Christianity and Islam have been selected for comparison. Descriptive, analytical and comparative methods have been adopted in preparing the article. The study has been able to prove that different civilizations of the world have deprived women from their rights especially from right of inheritance, while it is only Islam which has provided true dignity and right of inheritance to them.

সারসংক্ষেপ: নারী-অধিকার বর্তমান সময়ের আলোচিত একটি বিষয়। নারী অধিকারের মধ্যে সবচেয়ে গুরুত্বপূর্ণ হল তার সম্পদের উত্তরাধিকার। বিভিন্ন সভ্যতা ও ধর্ম নারীকে ভিন্ন ভিন্ন দৃষ্টিকোণ থেকে দেখেছে। কোন কোন সভ্যতায় নারীকে তার সব ধরনের অধিকার থেকে বঞ্চিত করা হয়েছে। আবার কোন কোন সভ্যতায় তার মর্যাদার স্বীকৃতি দেয়া হয়েছে। এ সার্বিক প্রেক্ষাপটে বিভিন্ন ধর্মে সম্পত্তির উত্তরাধিকার বিষয়ক আইনে নারীর প্রাপ্য অংশ বিষয়ে তুলনামূলক পর্যালোচনার উদ্দেশ্যে আলোচ্য প্রবন্ধটি রচিত হয়েছে। গবেষণার পরিধি হিসেবে হিন্দু, বৌদ্ধ, ইহুদী, খ্রিস্ট ও ইসলাম ধর্মকে বেছে নেয়া হয়েছে। প্রবন্ধটি প্রস্তুত করার ক্ষেত্রে বর্ণনা, বিশ্লেষণ ও তুলনামূলক পদ্ধতি অনুসরণ করা হয়েছে। প্রবন্ধ থেকে প্রমাণিত হয় যে, পৃথিবীর বিভিন্ন সভ্যতায় বিশেষত সম্পত্তির উত্তরাধিকারের ক্ষেত্রে নারীকে অধিকার-বঞ্চিত করা হয়েছে। একমাত্র ইসলামই নারীকে তার যথার্থ মর্যাদা ও সম্পত্তির উত্তরাধিকার প্রদান করেছে।
