Abstract

Throughout human history, monetary systems have evolved and changed to facilitate trade. Due to the tremendous development of modertn technology cryptocurrencies have started to dominate the traditional monetary system since the beginning of the 21^st century. Cryptocurrency is a collection of binary data that acts as a medium of exchange. This virtual currency exists only online. Cryptocurrencies can be traded in the global digital asset market. This research paper attempts to explore the provisions of cryptocurrencies from the perspective of Islamic law. The prime objective of this article is to analyze and determine the legality and illegality of cryptocurrency in contemporary Islamic law based on the opinion different schools of thought. This research paper, written in a descriptive and analytical manner, after presenting and analyzing various evidences of modern jurists, has demonstrated that cryptocurrency can be approved subject to certain recommendations and it is possible to legitimize cryptocurrency for the purpose of facilitating people’s financial transactions in the context of changing times.

সারসংক্ষেপ : মানব ইতিহাসে বাণিজ্যিক কার্যক্রম সহজতর করার উদ্দেশ্যে মুদ্রা ব্যবস্থার পরিবর্তন ও বিবর্তন সাধিত হয়েছে। একবিংশ শতাব্দীর শুরুতে আধুনিক প্রযুক্তির বদৌলতে ক্রিপ্টোকারেন্সি প্রচলিত মুদ্রাব্যবস্থায় প্রভাব বিস্তার করতে আরম্ভ করেছে। ক্রিপ্টোকারেন্সি হলো বিনিময়ের মাধ্যম হিসেবে কাজ করা বাইনারি ডাটার একটি সম্ভার। এ ভার্চুয়াল মুদ্রার অস্তিত্ব শুধু অনলাইনেই পাওয়া যায়। বৈশ্বিক ডিজিটাল সম্পদের বাজারে ক্রিপ্টোকারেন্সি দিয়ে কেনা-বেচা করা যায়। বক্ষ্যমাণ গবেষণা প্রবন্ধটিতে ইসলামী আইনের দৃষ্টিতে ক্রিপ্টোকারেন্সির বিধান অনুসন্ধানের প্রয়াস চালানো হয়েছে। ফিকহী মতামতের ভিত্তিতে সমকালীন ইসলামী আইনে ক্রিপ্টোকারেন্সির বৈধতা ও অবৈধতা বিশ্লেষণ ও নির্ণয় করা এ প্রবন্ধের মূল উদ্দেশ্য। বর্ণনামূলক ও বিশ্লেষণমূলক পদ্ধতিতে রচিত এ গবেষণা প্রবন্ধটিতে আধুনিক ফকীহদের উপস্থাপিত বিভিন্ন প্রমাণাদি বিশ্লেষণ করে দেখানো হয়েছে যে, নির্দিষ্ট সুপারিশের ভিত্তিতে ক্রিপ্টোকারেন্সি অনুমোদিত হতে পারে এবং পরিবর্তিত সময়ের প্রেক্ষাপটে জনগণের আর্থিক লেনদেন সহজীকরণের উদ্দেশ্যে ক্রিপ্টোকারেন্সির বৈধতা দেয়া সম্ভব।
