ইসলাম ও প্রচলিত আইনে খনিজ সম্পদের ব্যবহার নীতি : একটি তুলনামূলক পর্যালোচনা |Mineral Resource Utilization Policy in Islamic and Conventional Law : A Comparative Review

Abstract

Natural resources have contributed significantly to the development of modernity and civilization of the world. There are huge reserves of these minerals in different regions and countries. Economic development and prosperity will surely come if a fair approach is adopted in its exploration, discovery, extraction and balanced use as well as distribution. Although the Muslim world has a large reserve of mineral resources, they are backward in many ways in terms of socio-economic development. Due to the socio-economic condition, geo-political location and lack of technical capacity of the underdeveloped and developing countries, it is not possible to extract different minerals despite the demand. In that case, developed countries and multinational corporations are extracting and commercializing resources on a partnership or profit basis. However, the people of these countries are not able to enjoy their own country’s resources easily and equitably. As a result, it has an adverse effect on socio-economic development. Islam has provided different instructions for the overall improvement of humankind. This article has discussed the principles of mineral resource utilization in the light of Islamic and conventional law. Premising on descriptive and comparative manner, this study has ventured to present a description, elucidation and effectiveness of the Islamic principles and Conventional laws on mineral resources. This article has substantiated that if mineral resources are extracted and utilized through fair distribution of resources according to Islamic guidelines, it will be able to play a more effective role in the overall development of the country including poverty alleviation.

সারসংক্ষেপ : পৃথিবীর আধুনিকতা ও সভ্যতার ক্রমবিকাশে প্রাকৃতিক সম্পদভুক্ত খনিজ সম্পদ তাৎপর্যপূর্ণ অবদান রাখে। বিভিন্ন দেশে রয়েছে এ খনিজ সম্পদের বিশাল ভা-ার। এর অনুসন্ধান, আবিষ্কার, আহরণ, উত্তোলন এবং সুষম ব্যবহার-বণ্টনে ন্যায়ানুগ পন্থা অবলম্বন করা হলে নিশ্চিতভাবে অর্থনৈতিক উন্নতি ও সমৃদ্ধি আসবে। অথচ মুসলিম বিশে^র মালিকানাধীন বিপুল পরিমাণ খনিজ সম্পদ থাকলেও আর্থ-সামাজিক উন্নয়নে তারা আজ নানাভাবে অনগ্রসর। অনুন্নত ও উন্নয়নশীল দেশসমূহের আর্থ-সামাজিক অবস্থা, ভূ-রাজনৈতিক অবস্থান ও প্রযুক্তিগত সামর্থ্যের অভাব থাকায় চাহিদা সত্ত্বেও অনেক খনিজপদার্থ আহরণ করা সম্ভব হচ্ছে না। সেক্ষেত্রে উন্নত   দেশসমূহ এবং বহুজাতিক প্রতিষ্ঠানগুলো অংশীদারত্ব কিংবা লাভজনক ভিত্তিতে সম্পদ আহরণ ও বাণিজ্যিকীকরণ করছে। তবুও, এসকল দেশের জনগণ নিজের দেশের সম্পদ সুলভ ও সুষমভাবে ভোগ করতে পারছে না। ফলে, আর্থ-সামাজিক উন্নয়নে এর বিরূপ প্রভাব পড়ছে। ইসলাম মানবজাতির সার্বিক উৎকর্ষ সাধনে বিভিন্ন নির্দেশনা প্রদান করেছে। বক্ষ্যমাণ প্রবন্ধে ইসলাম ও প্রচলিত আইনে খনিজ সম্পদের ব্যবহার নীতি সম্পর্কে আলোচনা করা হয়েছে। বর্ণনামূলক এবং তুলনামূলক পদ্ধতিতে রচিত প্রবন্ধটিতে খনিজ সম্পদ সম্পর্কে ইসলামী নীতি ও প্রচলিত আইন-বিধির বিবরণ, বিশ্লেষণ ও কার্যকারিতার বিষয়ে পর্যালোচনা উপস্থাপন করা হয়েছে। প্রবন্ধের মাধ্যমে প্রমাণিত হয়েছে যে, ইসলামী দিকনির্দেশনা অনুযায়ী সম্পদের ইনসাফপূর্ণ বণ্টনের মাধ্যমে খনিজ সম্পদ আহরণ, উত্তোলন ও ব্যবহার করা হলে তা দারিদ্র্য বিমোচনসহ দেশের সার্বিক উন্নয়নে অধিক ফলপ্রসূ ভূমিকা রাখতে সক্ষম হবে।
