ভূমিদূষণ প্রতিরোধে বাংলাদেশের বিদ্যমান আইন ও ইসলামী নির্দেশনা|Existing Laws of Bangladesh and Islamic Guidelines to Prevent Land Pollution

Abstract

Land pollution is detrimental to flora and fauna. Land is a very delicate layer of the earth's crust, on whose characteristics the agricultural system is based. Therefore, if the land gets polluted, the crops produced from that land also become harmful to the human body. In the contemporary world, land pollution has become an acute environmental problem, which is having a huge impact on human health. The legal framework of Bangladesh is not able to play an effective role in solving this problem. The purpose of this study is to assess the impact of Islamic guidelines in the context of Bangladesh from a legal perspective. The research will facilitate the proper application of Islamic legal solutions to prevent land pollution. Content analysis method has been employed as part of the qualitative research method in this study. The study demonstrates that the legal framework of Bangladesh includes various motivational, remedial, and punitive provisions to prevent land pollution. Almost all these provisions are supported by Islamic guidelines, but various inconsistencies are found in the penal provisions and in the implementation of the law. Overall, this research can serve as an independent supportive component in preventing land pollution in Bangladesh.

সারসংক্ষেপ : ভূমিদূষণ উদ্ভিদ ও প্রাণিজগতের জন্য ক্ষতিকর। ভূমি হলো পৃথিবীর ভূত্বকের একটি অতি সূক্ষ্ম স্তর, যার বৈশিষ্ট্যের ওপর কৃষি ব্যবস্থা প্রতিষ্ঠিত। সুতরাং ভূমি দূষিত হলে, সেই ভূমি থেকে উৎপাদিত ফসলও মানবদেহের জন্য ক্ষতিকর হয়ে ওঠে। বর্তমান বিশ্বে ভূমিদূষণ এক গুরুতর পরিবেশগত সমস্যায় পরিণত হয়েছে, যা মানবস্বাস্থ্যের ওপর বিরাট প্রভাব ফেলছে। বাংলাদেশে এ সমস্যার সমাধানে সরকারের আইনগত কাঠামো কার্যকর ভূমিকা রাখতে পারছে না। এই গবেষণার উদ্দেশ্য হলো আইনগত দৃষ্টিকোণ থেকে বাংলাদেশের প্রেক্ষাপটে ইসলামী দিকনির্দেশনার প্রভাব অনুধাবন করা। গবেষণাটি ভূমিদূষণ প্রতিরোধে ইসলামী আইনগত সমাধানের যথাযথ প্রয়োগে সহায়ক ভূমিকা রাখবে। এ গবেষণায় গুণগত গবেষণা পদ্ধতির অংশ হিসেবে কনটেন্ট অ্যানালাইসিস পদ্ধতি ব্যবহার করা হয়েছে। গবেষণায় দেখা গেছে যে, বাংলাদেশের আইনগত কাঠামোয় ভূমিদূষণ প্রতিরোধে নানাবিধ উদ্বুদ্ধকরণমূলক, প্রতিকারমূলক এবং শাস্তিমূলক বিধান বিদ্যমান। এসব বিধানের প্রায় সবক্ষেত্রেই ইসলামী দিকনির্দেশনা দ্বারা সমর্থনযোগ্য, তবে শাস্তিমূলক বিধান এবং আইন বাস্তবায়নের ক্ষেত্রে ইসলামী বিধানের সঙ্গে বিভিন্ন অসঙ্গতি পরিলক্ষিত হয়। সর্বোপরি, বাংলাদেশে ভূমিদূষণ প্রতিরোধে এই গবেষণা একটি স্বতন্ত্র সহায়ক উপাদান হিসেবে ভূমিকা রাখতে সক্ষম।
