অপরাধ দমনে ইসলামী ও প্রচলিত আইনের কার্যকারিতা: একটি তুলনামূলক পর্যালোচনা| Effectiveness of Islamic and Conventional Laws in Crime Prevention: A Comparative Review

Abstract

Human character possesses both good and evil behavioral tendencies. When evil tendencies dominate, a criminal mindset develops. Crime, in turn, poses a threat to the order of society and the state. To mitigate this threat, Allah has imposed rules of what to enjoin and what to forbid throughout the ages. For the followers of the final and greatest Prophet, Muhammad (PBUH), specific laws and regulations have been ordained by Allah and His Messenger (PBUH). Although various laws have been enacted in Bangladesh following the conventional social and state systems, the desired success in crime prevention has not yet been achieved. Behind this failure to curb crime lie various factors, including the lack of the rule of law, as well as political and administrative interference. Conversely, a review of the period following the advent of Islam in the crime-prone Jahiliyyah (pre-Islamic) society reveals that wherever Islamic teachings were followed and Islamic law was implemented, unprecedented success in crime prevention was achieved. A primary reason for this success is that Islam emphasizes the formation of a crime-averse generation by awakening religious values. Under these circumstances, one of the main objectives of this article is to determine a methodology for crime control through a comparative review of various aspects of Islamic and conventional laws.

সারসংক্ষেপ : মানুষের চরিত্রে ভালো-মন্দ উভয় ধরনের কর্মপ্রবণতা রয়েছে। মন্দ কর্মপ্রবণতা শক্তিশালী হলে অপরাধের মানসিকতা সৃষ্টি হয়। আর অপরাধ সমাজ ও রাষ্ট্রের শৃঙ্খলার জন্য হুমকি। এ হুমকি নিরসনে যুগে যুগে আল্লাহ তাআলা পালনীয় ও বর্জনীয় বিধি-বিধান আরোপ করেছেন। সর্বশেষ ও সর্বশ্রেষ্ঠ নবী মুহাম্মদ #-এর উম্মতের জন্য আল্লাহ ও রাসূল # কর্তৃক বিভিন্ন বিধি-বিধান দেয়া হয়েছে। প্রচলিত সমাজ ও রাষ্ট্রব্যবস্থার অনুসরণে বাংলাদেশে বিভিন্ন আইন প্রণয়ন করা হলেও অপরাধ দমনে এখনও প্রত্যাশিত সফলতা আসেনি। অপরাধ দমনে এ ব্যর্থতার পেছনে আইনের শাসনের অভাব, রাজনৈতিক ও প্রশাসনিক হস্তক্ষেপসহ নানাবিধ কারণ বিদ্যমান। পক্ষান্তরে অপরাধপ্রবণ জাহিলি সমাজে ইসলামের যাত্রা পরবর্তী সময় পর্যালোচনা করলে দেখা যায়, যেখানেই ইসলামের শিক্ষা অনুসৃত হয়েছে এবং ইসলামী আইন বাস্তবায়িত হয়েছে সেখানে অপরাধ দমনে অভাবনীয় সাফল্য অর্জিত হয়েছে। এ সাফল্যের অন্যতম কারণ হলো, ধর্মীয় মূল্যবোধ জাগ্রত করার মাধ্যমে অপরাধবিমুখ প্রজন্ম গঠনের ওপর জোর দেওয়া হয়েছে ইসলামে। এমতাবস্থায় ইসলামী ও প্রচলিত আইনের বিভিন্ন দিক তুলনামূলক পর্যালোচনার মাধ্যমে অপরাধ নিয়ন্ত্রণের একটি কর্মপদ্ধতি নির্ধারণ করা এ প্রবন্ধের অন্যতম উদ্দেশ্য।
