In this dynamic era of technological advancement, the advent of Generative Artificial Intelligence and the subsequent proliferation of deepfakes have triggered a profound crisis of digital trustworthiness by fundamentally threatening human dignity and the right to privacy. Legal measures aimed at curbing cybercrime in Bangladesh have long been perceived as instruments for suppressing political dissent. Although the newly introduced Cyber Security Act 2026 attempts to amend these previous harsh measures, this research paper highlights its lack of a robust ethical foundation or explicit definitions necessary to safeguard freedom of speech while effectively addressing the very real threats posed by AI-driven defamation. Employing a qualitative and normative legal research methodology, this study conducts a comparative analysis between the provisions of the Cyber Security Act 2026 and Islamic jurisprudence (Fiqh). The research contends that conventional legal frameworks are inadequate for meeting the challenges of the AI era, thereby proposing the integration of Islamic legal principles. By codifying digital defamation, the state can establish precise and objective boundaries for cyber offenses. Furthermore, the application of discretionary punishments (Tazir) can redirect legal focus toward restorative justice aimed at recovering the honor and dignity of victims of synthetic media. Ultimately, this Shariah-based framework can supply the evidentiary standards required to severely punish malicious deepfake creators while simultaneously ensuring the active protection of legitimate Nasiha (sincere counsel) or constructive political criticism, and freedom of expression within the digital public sphere.
