ইসলামী ব্যাংকিং-এ প্রচলিত হায়ার পারচেজ : একটি শরয়ী বিশ্লেষণ | Hire Purchase Practices in Islamic Banking: A Sharī،ah Analysis

Abstract

Hire Purchase is one of the investment methods on which Islamic Banks are specifically dependent upon. The names and terms associated with the concept differ according to the country location or type of bank, but the concept of the method remains. On basis of nature of applying method and fame the paper presents a brief discussion about three methods, namely al-Ijarah bil bay tahta shirkatil milk (HPSM), al-Ijarah al-Muntahiyyah bit tamleek (IMBT) and al-Ijarah thumma al-Bay (AITAB). The article specifically aims to discuss Sharī،ah issues related to Hire Purchase practices under Shirkatil Milk practiced in Bangladesh through introduction and discussion of the pertinent Sharī،ah basis, application and application methods in Islamic Banks of Bangladesh, pertinent Sharī،ah issues etc. The Article has been prepared following descriptive and practical approaches. The research proves that application of discussed methods specifically the method practiced in Bangladesh according to Sharī،ah is possible and the income from this mode of investment can be lawful if it is exercised as per the instructions of Sharī،ah. However, it is important to note that one has to be careful regarding violations of the Sharī،ah in case of applying this product.

সারসংক্ষেপ: ইসলামী ব্যাংকসমূহ বিশেষভাবে যেসব বিনিয়োগ পদ্ধতির উপর নির্ভর করে ‘হায়ার পারচেজ’ বা ভাড়ান্তে ক্রয় তার অন্যতম। দেশ ও ব্যাংক ভেদে এ পদ্ধতিটি বিভিন্ন নামে পরিচিত। অত্র প্রবন্ধে প্রয়োগ পদ্ধতির ধরন ও প্রসিদ্ধির বিচারে ‘আল-ইজারা বিল বাই‘ তাহতা শিরকাতিল মিলক’ (HPSM), ‘আল-ইজারা আল-মুনতাহিয়্যা বিত তামলীক’ (IMBT) ও ‘আল-ইজারা ছুম্মা আল-বাই‘’ (AITAB) এ তিনটি পরিভাষার সংক্ষিপ্ত আলোচনা উপস্থাপন করা হয়েছে। বিশেষত বাংলাদেশে প্রচলিত ‘আল-ইজারা বিল বাই‘ তাহতা শিরকাতিল মিলক’ (الإجارة بالبيع تحت شركة الملك) বা Hire Purchase practices under Shirkatil Milk সংশ্লিষ্ট শরী‘আহ অনুষঙ্গসমূহ বিশ্লেষণের উদ্দেশ্যে প্রণীত এ প্রবন্ধে প্রডাক্টটির পরিচিতি, শর‘য়ী ভিত্তি, বাংলাদেশের ইসলামী ব্যাংকসমূহে এর প্রয়োগ ও প্রয়োগ পদ্ধতি, শরী‘আহ অনুষঙ্গ ইত্যাদি আলোচনা বিধৃত হয়েছে। প্রবন্ধটি রচনার ক্ষেত্রে বর্ণনামূলক ও প্রায়োগিক পদ্ধতির আশ্রয় নেয়া হয়েছে। বক্ষ্যমাণ গবেষণা থেকে প্রমাণিত হয়েছে, আলোচিত হায়ার পারচেজের পদ্ধতিসমূহ, বিশেষত বাংলাদেশের ইসলামী ব্যাংকসমূহে অনুসৃত পদ্ধতিটি শরী‘আহসম্মত উপায়ে প্রয়োগ করা সম্ভব এবং যথাযথ শরী‘আহ পরিপালন করে এর প্রয়োগ করা হলে তা থেকে অর্জিত লভ্যাংশ সম্পূর্ণ হালাল। তবে এর প্রয়োগের ক্ষেত্রে সতর্কতা অবলম্বন জরুরী, যাতে কোনভাবেই শরী‘আহ লঙ্ঘিত না হয়।
